These Marketplace and Seller Terms ("Marketplace Terms") govern all buying and selling activity on the PerfumeBible marketplace. They apply in addition to, and should be read alongside, the main Terms of Service. Capitalised terms not defined here have the meanings given in the Terms of Service.
PerfumeBible operates a peer-to-peer marketplace where registered users may list and sell fragrance products — including full bottles, decants (measured portions), and fragrance-related accessories — to other users ("Buyers"). Sellers may be individuals or businesses.
PerfumeBible is the marketplace operator, not a party to the sale. Contracts for the sale of goods are formed between Buyer and Seller directly. However, PerfumeBible provides Buyer Protection (Section 9) and may intervene in disputes (Section 10).

To apply for Verified Seller status, complete the application in your seller dashboard. Approval is at PerfumeBible's discretion and subject to our KYC review.
Listing prohibited items may result in immediate removal, account suspension, and referral to law enforcement.
Listings must accurately describe the product including:
Deliberately misleading listings are a violation of these Terms and may constitute fraud under applicable law.
Sellers set their own prices. PerfumeBible does not fix or recommend prices. You are responsible for compliance with any applicable pricing regulations in your jurisdiction.
PerfumeBible charges the following commission on completed sales, deducted from the seller payout:

Commission is calculated on the item price excluding shipping.
Payment processing is handled by Stripe. Stripe's fees (currently approximately 1.5% + 20p for UK cards; 2.9% + 30¢ equivalent for other cards) are passed through to the seller and deducted in addition to Platform commission. See stripe.com/pricing for current rates.
Payouts to sellers are processed via Stripe Connect to your registered bank account. Stripe's standard payout schedule applies (typically 7 days for new sellers, reducing to 2 days for established accounts). PerfumeBible may apply additional holding periods for new sellers or high-value transactions pending our review.
We will give at least 30 days' notice of any increase in commission rates. Transactions initiated before the effective date of any fee change are subject to the rates in force at listing.
PerfumeBible does not hold funds on its own account. Payment processing is handled entirely by Stripe in accordance with Stripe's terms.
The Seller is responsible for:
Sellers set their own shipping rates. Buyers pay shipping in addition to the item price. Shipping fees are not subject to Platform commission.
Sellers shipping internationally are responsible for compliance with export regulations in their country and import regulations in the Buyer's country, including any applicable customs duties or taxes. These are not covered by Platform commission and are the responsibility of the Buyer and/or Seller as applicable.
As a Buyer, you agree to:
By listing a product as authentic, the Seller warrants to the Buyer and to PerfumeBible that the product is genuine and as described. This warranty is the basis on which the Buyer makes their purchase.
If a Buyer receives a product they have reasonable grounds to believe is not authentic, they may raise an Authenticity Dispute under Section 10. PerfumeBible reserves the right to require the Seller to accept a return and provide a full refund including shipping in all directions.
Confirmed sale of counterfeit goods will result in:
PerfumeBible does not authenticate products before listing. We are not experts in fragrance authentication and do not provide authentication services. Community reputation scores and Verified Seller status are indicators of seller trustworthiness, not guarantees of product authenticity.
PerfumeBible Buyer Protection applies to all transactions completed through the Platform's payment system and covers:

Buyer Protection does not cover:
Conducting transactions off-platform to avoid commission voids Buyer Protection entirely. If a Seller solicits off-platform payment, report it to support@perfumebible.com.
Either party may raise a dispute through the Platform within the applicable time window. All communications regarding an active dispute must be conducted through the Platform's dispute interface.
Our dispute decisions are final within the Platform. They do not affect either party's statutory legal rights. Either party may pursue remedies through the courts or applicable consumer dispute resolution schemes regardless of our decision.
Where PerfumeBible determines that a dispute involves fraudulent conduct by either party, we will suspend the relevant account and may report the matter to Action Fraud (UK) or relevant authorities in the applicable jurisdiction.
This section applies to Buyers purchasing from Sellers who are businesses (not individuals).
Where the Seller is a business, your statutory rights under the Consumer Rights Act 2015 apply. Goods must be:
You have the right to reject goods and receive a full refund within 30 days if they do not conform. After 30 days you may be entitled to repair, replacement, or partial refund.
If the Seller is an individual (private seller): consumer rights legislation generally does not apply. The transaction is governed by these Marketplace Terms and general contract law. This is why accurate listing descriptions are important — an individual Seller can be liable for misrepresentation.
PerfumeBible will indicate on Seller profiles where a Seller is operating as a business.
Sellers are responsible for determining and discharging any tax liability arising from their sales, including income tax, VAT (if applicable), and any other applicable taxes in their jurisdiction.
If you are a business seller and are VAT registered, you are responsible for charging and accounting for VAT correctly.
PerfumeBible may be required by law (including the OECD DAC7 / UK Digital Platform Reporting Regulations) to report seller transaction data to HMRC. By selling on the Platform, you consent to such reporting where legally required.
In addition to the general prohibited conduct in the Terms of Service, Sellers may not:
PerfumeBible may remove any listing and/or suspend any seller account at any time if we believe it violates these Marketplace Terms, the Terms of Service, or applicable law. We will inform the Seller where we are permitted to do so. Pending transactions at the time of suspension will be handled in accordance with Buyer Protection.
These Marketplace Terms are governed by the laws of England and Wales. Disputes arising under these Terms are subject to the dispute resolution provisions of our Terms of Service.
