By accessing or using perfumebible.com and any associated applications (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
These Terms form a legally binding agreement between you and PerfumeBible Ltd, a company registered in England and Wales (Company Number: [NUMBER]), with registered address at [ADDRESS] ("PerfumeBible", "we", "us").
If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
You must be at least 16 years old to use the Platform. By using it, you confirm you meet this requirement. To buy or sell through our marketplace, you must be at least 18 years old and legally capable of entering contracts in your jurisdiction.
To access most features, you must create an account with a valid email address and a unique username. You are responsible for all activity under your account.
Your username is your public identity on the Platform. You may change it once every 30 days. Usernames may not impersonate another person, use a brand name without authorisation, or contain offensive content as determined by our Community Guidelines.
You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately at security@perfumebible.com if you suspect unauthorised access. We are not liable for losses caused by unauthorised account use where you have failed to take reasonable precautions.
You may delete your account at any time via Settings. Upon deletion, your personal data is handled as described in our Privacy Policy. Public reviews may be anonymised rather than deleted to preserve community data integrity; you may request full removal at deletion.
We may suspend or terminate your account immediately if you breach these Terms, the Community Guidelines, or the Marketplace Terms; if we are required to do so by law; or if your account is involved in fraud or abuse. We will give notice where we are permitted to do so. You may appeal by contacting support@perfumebible.com.
PerfumeBible is a fragrance encyclopaedia, community, and marketplace. We provide:
We aim to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. We will give reasonable notice of material changes where practicable.
Encyclopaedia content, note pyramids, classifications, and scores on the Platform are provided for informational purposes. We do not guarantee accuracy. Community-contributed data reflects user opinions. Do not rely solely on Platform data for purchasing decisions.
"User Content" means anything you post, submit, or upload to the Platform — reviews, check-ins, list descriptions, profile information, messages, or any other material.
By posting User Content, you grant PerfumeBible a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, modify, adapt, publish, display, and distribute that content in connection with operating and promoting the Platform. This licence ends when you delete the content or your account (subject to the anonymisation provision in Section 3.4).
You represent and warrant that:
We may review, moderate, remove, or restrict access to any User Content at any time without notice, if we believe it violates these Terms, our Community Guidelines, or applicable law.
We do not endorse User Content. Reviews and ratings reflect individual user opinions, not PerfumeBible's views.
You may not use the Platform to:
Violation of these prohibitions may result in immediate account termination and, where appropriate, referral to law enforcement.
The Platform, its design, code, database schema, scoring models, and all original content created by PerfumeBible are owned by or licensed to PerfumeBible Ltd and protected by copyright, trade mark, and other intellectual property laws.
Fragrance names, brand names, perfumer names, and note pyramids are factual information. We do not claim proprietary rights over factual fragrance data. However, the selection, arrangement, and presentation of data on the Platform is our intellectual property.
If you provide feedback or suggestions about the Platform, we may use them without obligation to you.
The Platform integrates third-party services including Stripe (payments), fragrance affiliate partners, and others. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.
Links to external retailer sites are provided as a convenience. We do not endorse and are not responsible for those websites or their content.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
Nothing in these Terms excludes liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence, or for fraud).
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
PerfumeBible's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the greater of: (a) the amount you paid to PerfumeBible in the 12 months preceding the claim, or (b) £100.
PerfumeBible shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, or loss of goodwill, even if advised of the possibility of such damages.
PerfumeBible is not liable for the conduct of other users or for any content posted by users.
These limitations apply regardless of the form of action.
You agree to indemnify, defend, and hold harmless PerfumeBible Ltd and its officers, directors, employees, and agents from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third party's rights.
Marketplace transactions between buyers and sellers are governed by our Marketplace and Seller Terms, which are incorporated into these Terms by reference. In the event of conflict between these Terms and the Marketplace Terms on marketplace matters, the Marketplace Terms prevail.
Details of our Pro subscription, including pricing, features, cancellation, and refund rights, are set out on the subscriptions page and are incorporated into these Terms by reference.
Your statutory cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply. For digital services, you have 14 days to cancel from the date of subscription unless you have expressly requested the service begin within that period and acknowledged your right to cancel is waived.
These Terms are governed by the laws of England and Wales.
Before bringing a formal claim, we encourage you to contact us at legal@perfumebible.com to resolve disputes informally. We will try to resolve any dispute within 30 days.
If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable law requires otherwise (for example, consumers in EU member states may have the right to bring proceedings in their local courts).
EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.
We may update these Terms from time to time. We will notify you of material changes by email or by prominent notice on the Platform at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance. If you do not accept the new Terms, you must stop using the Platform and may delete your account.
Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, Community Guidelines, and (where applicable) Marketplace Terms, constitute the entire agreement between you and PerfumeBible regarding the Platform.
Severability. If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary, or severed, and the remaining provisions will remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so in the future.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign ours in connection with a merger, acquisition, or sale of assets.
